FMCSA Renews Hollywood Exemption on Truck Driver Hiring Rules

This renewal follows our successful demonstration that DECS’s hiring protocols, while more streamlined than those required for general freight haulers, continue to uphold federal safety standards. The exemption, originally granted in 2020, allows DECS member carriers to conduct limited queries of the FMCSA’s Drug & Alcohol Clearinghouse during pre-employment screening and will remain in effect through 2030.

 

What Is the Exemption?

Initially granted in 2020, the FMCSA exemption permits our carriers to perform limited queries of the Drug & Alcohol Clearinghouse during pre-employment screenings rather than the full queries typically required for commercial motor vehicle (CMV) operators in general freight. This streamlined process enables production companies to onboard drivers more quickly, a critical need in a time-sensitive, project-driven industry like film and television.

This change may seem small, but it plays a critical role in enabling rapid onboarding. In the fast-moving world of film and TV, every hour matters and being able to bring drivers on board quickly keeps productions running on time and on budget. With the FMCSA's recent announcement, the exemption has been extended for another five years and is now set to expire in 2030. The new expiration date provides long-term certainty, allowing studios and production companies to plan confidently.

At the same time, the extension signals that continued vigilance will be necessary. We must demonstrate over the next five years that its safety protocols continue to meet or exceed federal standards. We remain committed to upholding and exceeding federal safety standards. Companies like Netflix Studios LLC and Sony Pictures Entertainment submitted comments to the FMCSA in support of the renewal. Netflix noted that the exemption “reduces administrative obstacles, enabling faster project turnarounds with a consistent pool of drivers.”

This operational flexibility translates directly into economic value. Delays in hiring drivers can halt production, increase the number of filming days required, and significantly escalate costs. How Safety Is Still Maintained

  • Full Queries Still Required if Red Flags Exist: If a limited query indicates that information about a driver exists in the Clearinghouse, a full query must be performed before that driver can be permitted to operate a commercial vehicle.
  • Comprehensive Testing Remains in Place: Employers must still comply with all federal drug and alcohol testing regulations. In addition, we enforce our own robust protocols that go beyond the minimum regulatory requirements.
  • Consortium Management Model: We act as a consortium/third-party administrator (C/TPA), centralizing oversight and standardizing procedures across its members. This ensures consistency and accountability while helping employers remain compliant with DOT regulations.
