Cut-off levels have been established to rule out passive or second hand smoke inhalation.  Clinical studies have been conducted to establish the cut-offs, and the studies concluded that it is extremely unlikely for an individual to test positive due to passive or second hand smoke inhalation.

Do I need to run a CDLIS or worry about FMSCA regulations if my drivers only have Class B CDL's and do not go out of state?

If drivers are required to have a Class B CDL in order to operate vehicles, then the FMCSA Regulations in Part 382 and Part 383 will apply to your operations. Other areas of the regulations, such as Part 391 or Part 395, may apply to the motor carrier even if they don’t leave the state. Those sections apply to motor carriers operating in interstate commerce, which cannot be determined based solely on never leaving a given state. Interstate commerce is an activity that might occur without a truck ever leaving a single city. We advise that you contact the FMCSA for assistance in determining the applicability of the regulations.

If an employee informs the employer that they are using a CBD product, what is the employers responsibility if that employee is in a safety-sensitive position?

The employer’s responsibility is to explain that there is no exception (under DOT regulations) for the use of any product that presents as THC metabolites and exceeds set thresholds on a DOT drug screen. If it is non-DOT, they should refer to the company policy. If the policy accepts CBD oil, then that should be communicated.

What kinds of criminal records show up on a background check?

Depending on the scope of the search allowable by law or requested by an employer, records of convictions of a felony or misdemeanor are usually reported on a background check. Non-convictions may be reported in some cases depending on the date of the charge or whether a case has been dismissed. Federal and state law will determine how far back criminal records can be reported.

How long is a background check good for access to a consortium owner site?

In most cases, a background check is good for two years. You should check with the contractor employer for a specific owner’s time frame.
