Important Update: Guidance on Converting DOT-Regulated Testing Results to Non-DOT

New guidance from the Office of Drug and Alcohol Policy and Compliance (ODAPC) on behalf of each DOT Agency has been issued, impacting the process for converting federally regulated drug tests to non-regulated status. Below, we detail these updated procedures and their implications for our clients and Medical Review Officers (MROs).

An employer’s request to convert a DOT test result to a non-DOT test result should be made directly to the appropriate DOT Agency Drug and Alcohol Program Manager.  Each DOT Agency has established its own requirements and procedures for consideration of requests to convert DOT test results to non-DOT test results.  This is to avoid future problems on incorrectly converted tests and to ensure that an employee subject to DOT testing with a positive result or refusal complies with the mandatory return-to-duty requirements.

Non-negative test results: 

Employers must contact the DOT Agency Program Manager to request conversion. This step is crucial: without the DOT agency's approval, a specimen cannot be transitioned to a non-regulated status.

Negative test results:

  • For FAA or PHMSA tests, Employers must contact the respective DOT Agency Program Manager to request conversion.

  • Employers can determine the conversion for FMCSA, FTA, or FRA tests without consulting the respective DOT Agency Program Manager but must document the change with a Memorandum for the Record (MFR).
