Oklahoma Governor Signs House Bill to Fund Pilot Program for THC Breathalyzers

The Governor of Oklahoma, Kevin Stitt, signed a bill on May 21, 2020, that would dedicate $300,000 towards a THC breath test pilot program. House Bill 4164 features a pilot program that would be used by state and local law enforcement to help solve problems with THC detection windows in current drug testing methods.

FMCSA Grants MPCS Exemption for Clearinghouse Rule

The Motion Picture Compliance Solutions (MPCS) exemption to the Federal Motor Carrier Safety Administration (FMCSA) Drug and Alcohol Clearinghouse Rule has been granted after stating that it didn’t fit their industry’s model. The exemption is for its members who employ commercial driver’s license (CDL) holders providing transportation to or from a theatrical, commercial, or television production site and are subject to drug and alcohol testing.

New York City Adds New Exemption to Their Pre-Employment THC Testing Ordinance

The legalization of marijuana varies by state, causing employers to request safety-sensitive carve-outs to help them enforce safety in the workplace for positions that pose a risk. As state medicinal and recreational marijuana legislation pass, it’s vital that employers remain up-to- date on any recent changes that affect safety-sensitive carve-outs so as to not compromise safety, while also understanding their liability protections. New York City, for example, recently updated a rule that adds six new safety-sensitive positions to the carve-out included in the ordinance.

FMCSA Announces Drug and Alcohol Testing Discretion

The coronavirus outbreak has caused disruptions to businesses, jobs, and the daily lives of individuals across America. As a result of uncertainty caused by the pandemic, there have been numerous questions regarding government mandates and potential exceptions associated with drug and alcohol testing requirement. The purpose of this blog is specifically focused on Federal Motor Carrier Safety Administration (FMCSA) and the current state of testing mandates. Therefore, employers must understand that the Federal Motor Carrier Safety Administration (FMCSA) requirements have NOT been suspended. The FMCSA emphasized that employers that remain capable of meeting the random testing requirements outlined in Part 382 must continue to do so. Per the FMCSA, “This Notice is not intended, and should not be perceived, as suspending the current random testing requirements.”

Virginia Decriminalizes Marijuana, Preventing Employers From Inquiring About Past Convictions

Governor Ralph Northam signed House Bill 972 on May 21, 2020, making Virginia the 27th state to decriminalize marijuana. The new law took effect July 1, reducing the penalty of a person caught with an ounce or less of marijuana to a $25 civil fine. FMCSA Announces Pilot Program for Under 21 Interstate Commerce Drivers

The Federal Motor Carrier Safety Administration (FMCSA) has proposed a new pilot program allowing non-military drivers between the ages of 18-20 years old to operate a commercial motor vehicle (CMV) in interstate commerce. Currently, 49 states and the District of Columbia already allow 18 to 20-year-old CDL holders to operate CMVs in intrastate commerce (within state borders); this new program would allow them to cross state borders.
