New Jersey Legalizes Recreational Cannabis

On February 22, 2021, Gov. Murphy signed three bills related to cannabis legalization in the state. The laws largely did not impact employers until August 21, when the New Jersey Cannabis Regulatory Commission (CRC) finalized their rules around the sale and use of cannabis. The Social Security Administration has updated their Consent Based Social Security Number Verification (CBSV) form (SSA-89) from the 2018 version to the 2020 version. A California Court of Appeal has issued a ruling that has resulted in California courts prohibiting the use of dates of birth, driver license numbers, and other identifiers to filter online search results. By redacting date of births from the California court system’s terminal, it makes it more difficult to perform background checks. New York Department of Labor Issues Recreational Cannabis Guidance

Spring 2021 brought about the legalization of recreational cannabis for individuals 21 and older in the state of New York. The Marihuana Regulation and Taxation Act (the Act) was immediately effective and impacted workplace drug and alcohol testing practices. New York residents ages 21 and older can use, possess, and cultivate cannabis but are not permitted to do so in the workplace.
